A revolution
in litigation
Resolving
disputes historically, has been a long-winded process with cases taking years
to get to court and, along the way, costing vast amounts of money.
However,
in the light of the recent Woolf Reforms, the civil court system has been
revolutionised, affording corporations and individuals a much more effective
way of resolving conflict - through mediation.
Out of
court
Mediation
offers disputing parties a cheaper, faster resolution to their problems by
encouraging them to work together through a mediator to come to a mutually
acceptable solution - without having to resort to the courts.
An evolving
industry in the UK, mediation has been tried and tested in the USA where studies
show an average success rate of greater than 75%.
"All government, indeed every human benefit
and enjoyment, every virtue and every prudent act, is founded on compromise
and barter."
Edmund Burke
Speech in the House of Commons, on conciliation with the American colonies,
22nd March 1775
